OH SHIT!!! I Got Into A Car Accident, Now What??

Driving in LA is no joke.  I once got rear ended in a 5 car pile up while stopped at a red light.  When I got out of the car, the first thing I did was to ask if everyone was all right...then I suddenly paniced a bit because I wasnt sure what to do next.

Accidents happen.  When they do, knowing how to react can save you time, money, and stress.  Whether you or someone you know has already been involved in a motor vehicle accident, or you just want to be prepared in the event you are in a wreck, here is a step-by-step guide of what to do when you get hit by a car.

Be a human being.  Check to make sure nobody is hurt.  Nobody plans or WANTS an car crash.  So don't be a dick and start getting angry.  Asses the situation.  Are there any injuries or death? Investigate the extent of the damage, and call for assistance if necessary. In California, failure to stop at the scene of an accident in which you are involved could result in serious criminal hit-and-run charges.

Drivers involved in minor accidents with no serious injuries should move cars to the side of the road and out of the way of oncoming traffic.  Leaving cars parked in the middle of the road or busy intersection can result in additional accidents and injuries.  If a car cannot be moved, drivers and passengers should remain in the cars with seatbelts fastened for everyone’s safety until help arrives.  Make sure to turn on hazard lights and set out cones, flares or warning triangles if possible.

Contact the police immediately.  Police will immediately investigate the scene of the accident, take statements of witnesses, and will examine the other driver to check for drug or alcohol use.  The police can also be valuable witnesses to your injury at the scene, and they can assist in securing an admission of fault from the negligent driver.  A lot of times in LA, police will NOT show up if it is a fender bender.  Take pictures of the scene.

After the accident, exchange the following information: name, address, phone number, insurance company, policy number, driver license number and license plate number for the driver and owner of each vehicle.  Also, make a written description of each car, including year, make, model and color and the exact location of the collision and how it happened.

If the name on an auto registration is different than the driver, write down the relationship.
Use your camera to document the damage to all the vehicles.  Take photos of the scene of the accident as well.

Make immediate notes about the accident, including specific damages to all vehicles involved, witness information, etc.

Try to take pictures before anyone moves their vehicle. These photographs help support and recreate your version of the crash if necessary for your claim.

Obtain contact information of any witnesses.

State only the facts, and limit your discussion of the accident to the police and your insurance agent.
If possible, don’t leave the accident scene before the police and other drivers do.  What you say can and will be used against you. This is not limited to getting arrested. Other than stating the simple facts of what happened, it is best not to engage in a lengthy conversation with anyone at the scene that involves speculation, opinion, or assumptions. This includes your statement to the investigating officer preparing the police report. Do not accept blame for the accident or make any statements suggesting you may be responsible. Be as brief and succinct as possible.

Call your insurance agent and report the accident.  Ask your agent about any time limits for filing a claim.  If you plan on filing a claim, get the claims process started as soon as possible.  Your insurance company will investigate the loss, take statements and inspect the damage to both vehicles in order to determine the merits of your claim.

It is important to seek medical treatment immediately after an accident even if you feel you are not seriously injured.  Frequently, symptoms do not become apparent for several hours after an accident.  Unfortunately, many accident victims wait to get treatment.  Waiting to get treatment is not only bad for your physical well being, but will hurt your chances of getting a fair settlement for your injuries.
Do not sign any document unless it is for the police or your insurance agent.

Accidents are accidents, and if you are NOT hurt, it's not an excuse to sue someone so you can make rent.  Be a human being.  If you hit someone and it's your fault, the last thing you want to do is have someone comeing after you and raising your insurance rates to some unobtainable rate.  Be kind.  Don't be dramatic.  Filing a claim can be long and cofusing.  If you need to hire a person injury attorney...do what you need to do.
